Cuomo has said he banned indoor dining at restaurants and bars because it is “one of the few areas that we think we can actually make a difference.” But the suit notes that Manhattan, which has the largest number of restaurants in the state, has a positivity rate less than half that of many New York counties where indoor dining remains open.
