A grand jury has upgraded charges against a Mobile, Alabama veteran and former middle school teacher whose bullet fatally pierced an 11-year-old boy last May during a turkey hunt.

“We are disappointed the grand jury saw the case differently than the magistrate and the district attorney’s office that originally charged the case as manslaughter,” Spina told Al.Joshua Stewart Burks, 36, of Mobile, ,had initially been charged with reckless manslaughter, but the charge was upgraded to capital murder of a person under the age of 14 in the death of Troy Ellis, WPMI-TV reported.
